In order for real estate businesses to serve clients fairly, supervise staff, maintain compliance and enforce prescribed regulatory expectations set by NSW Fair Trading, time poor real estate agents need to comply with a substantial number of government regulations.
Without a clear roadmap (REOS), doing so is highly challenging, time consuming and error prone.
Under the new reforms NSW Fair Trading have the enhanced powers to not only penalize for non-compliance but to also suspend a business from trading until such time as breaches are rectified.

UNDER THE NEW REFORMS (23RD OF MARCH 2020)
More discretion in suspending licences will be given to the secretary of the Office of Fair Trading allowing a suspension for as long as is considered reasonably appropriate to investigate any matter and removing the artificial limit of 60 days.
Power to issue an immediate and extended suspension regarding specific additional grounds.
Extended suspension of the licence will be the result of any failure to submit an audit and remain suspended while the failure is investigated.
To strengthen procedural fairness, the disciplinary process will ensure that in the instance when certificate and licence holders are under suspension, they will be granted with a hearing process following the initial suspension of 60 days.
